We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Terms and conditions
We operate exclusively in accordance with the Allgemeine Deutsche Spediteurbedingungen 2017 – ADSp 2017 – (German Freight Forwarders’ General Terms and Conditions 2017) and – if they do not apply for performing logistics services – with the Logistics-AGB 2019 (General Terms and Conditions of Logistics-Services Providers, version 2019). Note: In clause 23 the ADSp 2017 deviate from the statutory liability limitation in section 431 German Commercial Code (HGB) by limiting the liability for multimodal transportation with the involvement of sea carriage and an unknown damage location to 2 SDR/kg and, for the rest, the customary liability limitation of 8.33 SDR/kg additionally to EUR 1.25 million per damage claim and EUR 2.5 million per damage event, but not less than 2 SDR/kg.
In addition, it is agreed that (1) clause 27 ADSp does not extend the liability of the freight forwarder, nor the attribution of fault of servants and other third parties, to the benefit of the principal beyond statutory provisions such as section 507 HGB, Art. 25 Montreal Convention, Art. 36 CIM, Art. 20, 21 CMNI; (2) the freight forwarder, acting as carrier by sea, is liable only for its own fault in the cases of nautical fault or fire on board listed in section 512 (2) no. 1 HGB; and (3) the freight forwarder, acting as carrier within the meaning of the CMNI, is not liable for nautical fault, fire on board or defects of the vessel under the conditions set out in Art. 25 (2) CMNI.
Liability insurance pursuant to clause 28 ADSp 2017 is placed through our insurance broker, Willis GmbH & Co. KG. Place of jurisdiction is Hamburg.
